Probate is the court process by which a Will is proved valid or invalid. Once the court determines the validity of the Will, the assets owned by the decedent are distributed according to the Will.
Powers of Attorney
A power of attorney is a written authorization to act on another’s behalf in private affairs, business, or some other legal matter, sometimes against the wishes of the other. The person authorizing the other to act can be named “grantor”, or “donor”, (of the power). The one authorized to act is the “agent”.
